Article 2 – Applicability
These terms and conditions apply to all offers, orders and agreements concluded through headspastore.com. Headspastore supplies professional head spa equipment and accessories, primarily to business customers (B2B). Provisions that by law only apply to consumers (B2C) are indicated as such.
Article 3 – Products and manufacturing
Headspastore designs and manufactures professional head spa equipment: head spa beds, tables, basins, chairs and related accessories. Head spa units are made to order in the finish selected by the customer. Minor deviations in colour, grain or finish compared to screen images and samples are inherent to made-to-order production and do not constitute a defect. Free colour samples are available on request before ordering.
Article 4 – Prices
All prices are in euros and exclusive of VAT, unless stated otherwise. VAT is calculated at checkout based on the country of invoicing. Business customers in another EU member state with a valid VAT number are invoiced at 0% VAT (reverse charge, art. 196 Directive 2006/112/EC). Shipping costs are charged as stated in Article 6. For deliveries outside the European Union, import duties, local taxes and customs clearance costs are payable by the customer and are never included in our prices.
Article 5 – Payment
Orders are paid in full at the time of ordering, by card or bank transfer. For made-to-order products, the production slot is reserved and production starts once full payment has been received. Invoices are issued digitally.
Article 6 – Delivery
- Made-to-order head spa units: indicative production and delivery time of 10–12 weeks, worldwide.
- Shipping for head spa units: €199 per unit, worldwide.
- Accessories and tools in stock are shipped separately at the rate shown at checkout.
Stated delivery times are indicative and not binding; we keep you informed of the production status of your order. A delay does not entitle the customer to compensation or cancellation free of charge. The risk of the products transfers to the customer at the moment of delivery. The customer ensures that the delivery address is accessible for freight delivery; additional costs caused by failed delivery attempts or inaccessible locations are payable by the customer.
Article 7 – Inspection on delivery and transport damage
The customer must inspect the products on delivery. Visible transport damage or an incorrect delivery must be reported within 48 hours of delivery via info@headspastore.com, including photos and the order number. Damage reported later than 48 hours after delivery cannot be attributed to transport.
Article 8 – Cancellation of made-to-order products (B2B)
Made-to-order products are produced specifically for the customer. Cancellation before the start of production: full refund minus payment processing costs. Cancellation after the start of production: a cancellation fee of 50% of the order amount applies. After dispatch, cancellation is no longer possible.
Article 9 – Right of withdrawal (B2C only)
Consumers have a statutory right of withdrawal of 14 days for stock items (such as tools and accessories), provided the products are unused and in their original packaging. Return shipping is at the consumer’s expense. The right of withdrawal does not apply to made-to-order products manufactured to the consumer’s specifications (art. VI.53, 3° Belgian Code of Economic Law), such as head spa units in a selected finish. The right of withdrawal does not apply to business customers.
Article 10 – Warranty
Headspastore grants a 2-year warranty on head spa units, for business and consumer customers alike, starting on the date of delivery. The warranty covers manufacturing and material defects in the frame, the basin, the structural construction and workmanship.
The warranty does not cover:
- wear parts and consumables, such as upholstery, mattresses, hoses, seals, filters and shower heads;
- electronic components (such as control units, lighting and motors), except when defective on arrival and reported within 48 hours of delivery;
- damage caused by improper use, incorrect installation or connection, overloading, or use other than normal professional use;
- damage caused by insufficient or incorrect maintenance; the maintenance instructions supplied with the product must be followed;
- damage caused by the customer or third parties, accidents, falls, water damage from incorrect connection, or modifications and repairs not carried out by Headspastore;
- normal wear and tear, discolouration and cosmetic traces of use.
Warranty claims are submitted via info@headspastore.com with the order number, a description and photos or video. If a claim is accepted, Headspastore will, at its option, repair the product, supply replacement parts or replace the product. Transport costs for warranty handling outside Belgium may be charged to the customer. Warranty handling never extends the original warranty period.
Article 11 – Liability
The liability of Headspastore is in all cases limited to the invoice value of the products concerned. Headspastore is not liable for indirect damage, including loss of turnover or profit, business interruption or damage to third parties. Nothing in these terms excludes liability that cannot be excluded by law.
Article 12 – Retention of title
All delivered products remain the property of Headspastore until full payment of all amounts due has been received.
Article 13 – Force majeure
In the event of force majeure (including production disruptions, transport disruptions, raw material shortages, government measures), the obligations of Headspastore are suspended for the duration of the force majeure. If the force majeure lasts longer than 90 days, both parties may dissolve the agreement for the part not yet performed, without entitlement to compensation.
Article 14 – Intellectual property
All designs, images, texts and product names on headspastore.com are the property of Headspastore/Gelasco and may not be reproduced or used without written permission.
Article 15 – Privacy
Personal data is processed in accordance with our privacy policy.
Article 16 – Applicable law and disputes
Belgian law applies to all agreements with Headspastore. Disputes are submitted exclusively to the competent courts of the Antwerp district, unless mandatory law provides otherwise. Consumers may also use the European ODR platform (ec.europa.eu/odr).
